The Chairman of the Executive Council  issues a new resolution on Rules and Regulations of Overtime Work.

His Highness Sheikh Sultan bin Mohd. bin Sultan Al-Qassimi, the Crown Price, Deputy Ruler of Sharjah and Chairman of the Executive Council issued the Resolution No.3/2007 regarding rules for regulating the overtime work.  As per clause No.1 of the Resolution, the Manager may instruct staff whose basic salaries not exceeding an amount of AED 4100L- for local staff and AED 3100/-  for non-locals, to work additional hours after the official working hours and during the week-end and official holidays.  The overtime payment of such staff should not exceed 30% of their basic salary with maximum amount of AED 800/- per month for the administrative staff and 40% of the basic salary with maximum amount of AED 1100/- per month for the technical staff.

As per Clause No.2, staff whose basic salaries exceeding the amounts stated in Clause No.1, may be instructed to carryout overtime work after the official working hours and during the week-end and official holidays against overtime payment of AED 800/- per month as maximum and with overtime working hours of 65 hours per month as maximum.  The overtime payment should be calculated by multiplying the maximum rate (AED 800) by numbers of working hours and dividing the result by 65 hours. 

As per Clause No.3 the overtime payment should be calculated on the basis of one overtime hour equivalent to one hour during the normal working days and one and half hour during the week-end and official holidays.

The overtime payment should be calculated after completing official working of 40 hours per week and 30 per week in Ramadan.

Calculation of the due overtime payment should be made by multiplying the basic salary by numbers of working hours and dividing the result by 240 hours. 

However, the total overtime payment should not exceed the allocation of overtime work in the budget of the department or the authority

Clause No.4 states that by the beginning of each month, the department or the authority should prepare lists of staff entitled to overtime payment against the last month  in order to be approved by the Directors or his representative.  The lists then should be submitted to the Control Department of Administration for verification and action.  The list should include the following details: 

  1. Name of the employee

  2. Position

  3. Basic Salary

  4. Number of daily overtime working hours during the month

  5. The total due payment

The resolution should be effective as from 1st March, 2002 and be published in the official gazette.  All concerned departments and authorities should comply with its contents.
